ASSIGNMENT, REASSIGNMENT, AND TRANSFER                           2180

1.         Assignment:

1.1      Personnel will normally be assigned initially by the superintendent or his delegate to positions that best meet the needs of the District based upon the preparation, certification, experience, and aptitude of the person.

2.         Reassignment and Transfer:

2.1      The Board reserves the right to reassign and transfer personnel to other positions for the betterment of the school system when conditions such as the following exist:

2.1.1   Increases or decreases of enrollment in various grades and classes.

2.1.2   Opening of new buildings or closing of old ones.

2.1.3   Changes in organization of the school system.

2.1.4   Addition or elimination of an educational service.

2.1.5   Vacancies created by promotions, leaves of absence, death, retirement,  resignation and the like.

2.1.6   The employee can better serve the District in the position to which he is   transferred.

2.2      The Board will receive and act upon recommendations for personnel reassignment and transfer in the light of each individual’s qualifications for the position and length of service in the school system -- in that order of priority.

3.         Personal Adjustment Transfers:

3.1      The Board will consider requests for personal adjustment transfers, compatible with the employee’s qualifications, on the assumption that a different environment will often promote professional growth and increased efficiency. Requests for such transfers will be made through the superintendent.

4.         Involuntary Transfers:

4.1      The superintendent shall have the right to transfer or alter the assignment of any employee when necessary, provided:

4.1.1   Written notice of transfer is given to the person or persons affected.

4.1.2   Reasons for transfer are given in writing if requested by the person or persons involved.

4.1.3   Opportunity to discuss the transfer with the superintendent or his representative is given.

4.2      A Principal or immediate supervisor may request the transfer of an employee when in his or her judgment it will benefit the employee, the school, or the District. Involuntary transfer requests stating specific reasons for the transfer shall be made to the Superintendent. A copy of the request shall be made available to the employee. The Superintendent shall review the request and recommend approval or denial of the transfer request.

4.3      In situations where an involuntary transfer becomes necessary due to a reduction in staff or for staff imbalance, a call for volunteers shall be made and if there are none, selection shall be made in the best interests of the District. In the case of an involuntary transfer due to a reduction in staff or for staff balance the administrator shall adhere to the following guidelines:

4.3.1   Employees required to transfer involuntarily shall be notified of the available openings for which they are qualified.

4.3.2   Employees identified for involuntary transfer shall list their preference for available positions. Positions will be filled by the District with consideration given to the employee priority listing.

4.3.3   Program need shall be based on the primary assignment description.

4.3.4   Whenever possible, an employee being transferred to a different assignment shall be notified of the transfer prior to the end of the school year.

4.3.5   The transferring employee shall be notified of the change in assignment in a conference with his or her supervisor or a designee.

4.3.6   When a teacher who has been involuntarily transferred cannot be placed in a position commensurate with appropriate endorsements and skill requirements, Reduction in Force guidelines (Policy 2220) will be implemented.

4.4      Decisions of the Board on transfers and the necessity thereof are final and not subject to the grievance procedure if the above procedure is followed. All notices are required by this paragraph shall be given as soon as possible.

5.         Voluntary Transfers

5.1      The District will advertise known job vacancies, together with required endorsements and skill requirements of the particular position, for the upcoming school year to all current employees as soon as the job position is approved. Transfer requests will be made according to the following guidelines:

5.2.     A Request for Transfer Form signed by the Principal, and a letter or resume which gives evidence of appropriate endorsements and requested skill requirements should be submitted to Human Resources no later than the closing date on the postings. After a teacher has submitted one transfer form and resume, requests for transfer to additional openings can be accomplished by contacting Human Resources no later than the closing date on the postings. Information from the first transfer request will be forwarded to other schools upon the request of the teacher, providing the contact is received before the closing date.

5.3.     Using a common set of criteria such as personnel files, requested qualifications, experience, etc., principals will review all letters of request for transfer and select the candidates to be interviewed.

5.4      Transfers will be made when administrators involved in the selection process agree that the transfer is in order, and where there are no problems related to releasing the employee from the school/District entity, where he/she is presently employed. Successful candidates will be notified in writing.

5.5      When the position has been filled, all candidates making application will be notified through a district communication sent to the local schools. Whenever possible, this notification shall be made before the end of the current school year.

5.6.     The District will not be obligated to consider transfer requests after May 15 for the ensuing school year.
